5 - The Right to Freedom of Movement
Freedom of circulation within the national territory
is guaranteed by the Constitution. It can be limited only by court decision. "All citizens have the right
to move freely within the territory, to leave it and to change their residence within the limits set by the law"
(Article 10 of the Constitution).
- Organic law no. 98-77 of November 2, 1998 amending law
no. 75-40 of May 19, 1975 and pertaining to passports and travel documents, specifies that the judge is the sole
reference with respect to prohibition from leaving the national territory or withdrawing a travel document.
