4 - The Right of Association

  • The Constitution of the Republic of Tunisia guarantees the freedom to create associations (Art. 8).

  • The law of November 7, 1959 sets the conditions under which this right may be exercised. A number of amendments introduced in this law have provided a definite development in the legal system governing the activties of associations in Tunisia. The law of August 2, 1988 substituted the system of declaration to the system of authorization. Since then, associations are dissolved exclusively by the judge, for serious reasons that are stipulated by law. On April 2, 1992, new amendments give greater specificity to the conditions of exercising the right to form associations, with a view to strengthening their role in civil society and encouraging the participation of a larger number of citizens in associative activity.

  • The steadily growing number of associations bears witness to the determination to strengthen their role in society: in 1987 there were some 2,000 associations; in 1998, the number exceeded 7,000, including associations defending the rights of women, children, the handicapped and the elderly.

  • April 23 of every year has been designated “National Associations Day”.
